2 - Online classes services
All participants (hereafter, 'Participant' or 'Participants') engaging in online classes services provided by EPHEBOS accept all clauses of this agreement by registering and participating in any services. For Participants under 18 years old (referred to in this Agreement as minor or child), parent/s or legal guardian/s are agreeing to all clauses in this agreement on behalf of themselves and their minor participant(s) by registering their minor participant(s) in any services.
In consideration of being allowed to participate in the services, Participant, or parent/s or legal guardian/s of a minor participant) on behalf of Children participant(s) acknowledge, understand, and agree as follows:
2.1 Subcontractors
2.1.1. EPHEBOS contracts with organizations that are independent contractors (not employees or agents of EPHEBOS) to provide some of the services. Although EPHEBOS has made efforts to locate responsible contractors, it does not supervise or control these contractors and is not legally liable or responsible for their conduct. Participants (and parent/s) acknowledge that they may independently investigate and assess these organizations, services and activities, if they choose to do so.
2.1.2. Participants or parent/s or legal guardians of minors grant permission for Participant to participate in all activities using subcontractors and further authorize EPHEBOS to sign any waivers and/or permission forms necessary for Participant to participate in these activities.
2.2 Teachers
2.2.1. Participants shall not contract or try to contract directly or indirectly with the teachers and tutors introduced by EPHEBOS.
2.2.2. In the event a Participant contracts or tries to contract directly or indirectly with a teacher or tutor introduced by EPHEBOS, EPHEBOS has the right to terminate the course with immediate effect and without any refund to the Participant.
2.3 Disputes
2.3.1. It is agreed that any dispute or cause of action arising between the parties, whether out of this agreement or otherwise, will be settled through a court of competent jurisdiction located in France, and shall be construed in accordance with the laws of France.
2.3.2. This Agreement is intended to be interpreted and enforced to the fullest extent allowed by law. If any portion of this Agreement is deemed unlawful or unenforceable, it shall not affect the enforceability of the remaining provisions, and those remaining provisions shall continue in full force and effect. Adult participant or parent/s of a minor participant agree they have carefully read, understand and voluntarily sign this Agreement and acknowledge that it shall be effective and binding upon them, their participating minor child, spouse and other family members, and their heirs, executors, representatives, subrogors and estate.
2.4. Other Provisions
Participant or parent/s or legal guardian/s of a minor Participant) agree:
2.4.1. to review and/or complete all required forms or materials received (including this Agreement and any other requested program forms), abide by the terms of those documents, and obey all EPHEBOS rules and other policies;
2.4.2. to comply with law and regulations of their country as far as online education is concerned; in particular, participants residing in PR China confirm that they own a foreign passport and/or do not breach any local regulation related to online learning.
2.4.2. to disclose to EPHEBOS representatives any mental, physical or emotional condition/s or limitation/s which might affect the Participant's ability to participate, and represent that the Participant is fully capable of participating without causing harm to him or herself or others;
2.4.3. Participants have read this agreement, fully understand its terms, understand that they have given up substantial rights by agreeing online through paying for tutoring or class/es, and agree freely and voluntarily without any inducement.
2.4.4. Participant was given ample time to review this agreement prior to agreement online and was not rushed or hurried in any way. If English is not Participant's first language, Participant acknowledges that he/she fully understands all of the agreement and requested translation assistance, at their own volition and expense, from a legal professional if needed.
2.4.5. Paying online classes to EPHEBOS is equivalent to signing this agreement.
2.5. Payments, Cancellation and Refund Policy
2.5.1 Full payment for the course must be made prior to starting the course upon receipt of the invoice from EPHEBOS.
2.5.2 All class cancellations need at least 48 hours' notice. If Participant cancels with less than 48 hours notice, Participant loses his/her paid-for class. If EPHEBOS cannot deliver a class as scheduled, a makeup class has to be arranged.
2.5.3. If a Participant cancels a course, he/she will get the money back related to the remaining classes after deducting a maximum of 10 classes and an administrative fee of 7% of the price of the cancelled classes.
2.5.3 If a refund is approved, it may take up to two (02) months from the date when the requisite paperwork is complete.
2.5.4. EPHEBOS does not allow students to transfer their enrolment, credit notes or course fees to any third party, except to siblings.
3 - Protection of personal data
3.1. EPHEBOS collects information about the user (when consulting or sending messages) to receive information and commercial communications likely to interest the user. This information is intended for these uses only and will in no case be made available to third parties. Personal data communicated to us via our website is only saved for the period of time necessary for the performance of their purpose.
3.2. In accordance with the provisions of the regulations in force relating to the protection of personal data, the user is informed that he has a right of access, rectification, opposition and portability of data concerning him.
